Welcome to Soomi. By accessing and using our website trysoomi.com and by purchasing any product, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree with any of the points, we ask you not to use the site or make purchases.

1. Definitions

  • "Soomi", "we", "our" or "us": the company operating the Soomi brand, located at Campos Elíseos 188, CDMX, Mexico.
  • "Site": trysoomi.com and all its subdomains.
  • "Product": Soomi EsoRepair and any other product sold through the site.
  • "User", "you": any person who visits the site or makes a purchase.

2. Acceptance of Terms

By using the site, you confirm that:

  • Prices are expressed in the currency indicated at checkout (USD for the United States, MXN for Mexico, etc.).
  • Prices may change without prior notice. Once your order is confirmed, the displayed price is final.
  • Promotions, discounts, and bundles are subject to availability and temporality.

4.3 Availability

  • Some products may be temporarily out of stock. In that case, we will notify you and offer a refund or reservation.
  • We reserve the right to limit the quantity of units per purchase (especially during restocks).

5. Orders and Payments

5.1 Order Process

By clicking "Buy" or "Try Soomi Now", you are making an offer to purchase. The purchase is considered accepted only when you receive the confirmation email with your order number.

5.3 Payment Verification

We reserve the right to verify suspicious payments before dispatching them. This may include contacting you directly. Orders that cannot be verified will be canceled and refunded.

5.4 Order Cancellation by Us

We may cancel orders for the following reasons:

  • Suspicion of fraud
  • Pricing or availability errors
  • Inability to ship to the indicated destination
  • Violation of these terms

In all cases, we will issue a full refund.

6. Subscriptions

If you opt for a monthly Soomi subscription:

  • Automatic charges: Your payment method will be automatically charged each cycle.
  • Cancellation: You can cancel at any time from your account or by writing to soporte@trysoomi.com. Cancellation must be made at least 3 days before the next renewal date.
  • Modifications: You can pause, change the frequency or the product from your account.
  • Refunds on subscriptions: The 90-day guarantee applies to the first order. Recurring orders are governed by the standard policy.

7. Shipping and Deliveries

Please refer to our Shipping Policy for detailed times, costs, and procedures. The stated deadlines are estimates and do not constitute an absolute guarantee. Soomi is not responsible for delays caused by carriers, customs, weather events, or force majeure.

8. Returns and Refunds

Please refer to our Refund Policy for full details. In summary: you have 90 days to request a full refund if you are not satisfied.

9. Product Legal Disclaimer

Soomi EsoRepair is a dietary supplement. It is not a medicine.

  • The statements made about Soomi EsoRepair have not been evaluated by the FDA (United States) or by COFEPRIS (Mexico) or by equivalent regulatory agencies in other countries.

  • Soomi EsoRepair is not intended to diagnose, treat, cure, or prevent any disease.

  • Testimonials and results shown on the site are individual and do not guarantee similar results in other users.

  • Before beginning use, especially if:

    • You are pregnant or breastfeeding
    • You are taking prescribed medications (including Omeprazole, Pantoprazole, Esomeprazole, or other PPIs)
    • You have diagnosed medical conditions
    • You have allergies to any of the ingredients

    Consult your doctor.

  • Never interrupt prescribed medication without professional supervision.

  • If you experience adverse effects, discontinue use immediately and consult your doctor.

Soomi does not replace professional medical attention, diagnosis, or treatment.

10. Intellectual Property

All content on the site (texts, images, logos, designs, videos, code) is the property of Soomi or its licensors and is protected by copyright, trademark, and intellectual property laws.

It is prohibited to copy, reproduce, distribute, modify, or create derivative works without prior written authorization. Unauthorized use may result in legal action.

The brand names "Soomi" and "EsoRepair" are trademarks in the process of registration or already registered. Their unauthorized use constitutes infringement.

11. User-Generated Content

If you post reviews, comments, photos, or other content on the site or our social media:

  • You guarantee that you have the rights to that content.
  • You grant Soomi a worldwide, royalty-free, and perpetual license to use it for marketing, advertising, and communications.
  • You agree that it may be moderated or removed at Soomi's discretion.

It is prohibited to post offensive, defamatory, illegal content or content that violates third-party rights.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Soomi will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the site or the products.
  • Soomi's total liability, in any case, will not exceed the amount paid by the user for the product in question.
  • Soomi does not guarantee that the site will be free of errors, viruses, or interruptions.

This does not limit your liability for obligations that cannot be limited by law (e.g., fraud, gross negligence, or personal injury caused by product defects).

13. Indemnification

14. Force Majeure

16. Governing Law and Jurisdiction

These terms are governed by the laws of:

  • Mexico (for users in Mexico and LATAM): Competent courts of Mexico City.
  • United States (for users in USA): Laws of the state of Delaware (where applicable). Disputes will be resolved by binding arbitration unless prohibited by law.

The parties expressly waive any other jurisdiction that might correspond to them.

17. Dispute Resolution

Before initiating any legal action, the parties will attempt to resolve the dispute amicably through direct negotiation for at least 30 days from the formal notification of the conflict.

If the dispute cannot be resolved, it will be submitted according to point 16.

18. Severability

If any provision of these terms is declared invalid or unenforceable by a competent court, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms of Service, along with the Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between the user and Soomi regarding the use of the site and the purchase of products. They supersede any prior agreement, oral or written.
